GENERAL TERMS AND CONDITIONS

  1. ARTICLES
These general terms and conditions of sale apply without restriction or reservation to all sales of products offered for sale on the site www.bellebasket.be and concluded between the customer-consumers and the company BELLE BARRUS BV.

 These terms and conditions shall be brought to the attention of the customers/consumers, who shall, on the one hand, be required to read them, together with the full descriptions of the products sold and the tariff and delivery conditions, before concluding a sale and, on the other hand, be deemed to accept them before confirming any order.

 The general terms and conditions of sale can be consulted at any time on the site www.bellebasket.be . Upon request, the customer-consumer may receive these terms and conditions free of charge by electronic means or by any other means.

 This version of the general terms and conditions of sale replaces and cancels the general terms and conditions with an earlier date of issue and takes precedence over all conditions agreed between the parties and will be replaced by any later version than the present one.

The site www.bellebasket.be is managed and operated by the company BELLE BARRUS BV, with registered office at Kattestraat 10 – 1750 Sint-Martens Lennik.

3. ORDER
Description of the products
The information about the products offered for sale can be consulted on the site www.bellebasket.be.

 The Customer must take note of this before placing an order and check that the technical description of the product meets his needs and requirements. The choice to purchase a product is the full responsibility of the Customer.

 Offers are valid within the limits of available stocks. BELLE BARRUS shall, to the best of its ability, ensure that the information displayed on the site is correct and up to date. BELLE BARRUS reserves the right to correct and modify the content of the site at any time and without prior notice.

 Only the description of the products mentioned on the site on the day that the client places the order is opposable to BELLE BARRUS within the limits set out below. All images and photographs are of an illustrative nature: the actual color of a product may vary slightly as a result of the process of digital photography and of the variations caused by the settings of the user’s computer (brightness, screen configuration …).

Applicable rates
The applicable rates are those listed on the site www.bellebasket.be on the day of the order.

 Any order placed via the www.bellebasket.be website shall constitute a distance contract between the client and BELLE BARRUS.  The Client places an order on the www.bellebasket.be site using the “add to cart” and “next” modules.

 The final confirmation of the order by the customer takes place after the confirmation of the shopping cart and after verification by the customer and under his own responsibility: From the description of the order / From the applicable price / From the delivery conditions and the delivery address / From the payment conditions.

 The final confirmation of the order by the customer implies the acceptance of these general terms and conditions of sale.  By placing the order, the customer is deemed to have read and accepted the general terms and conditions of sale.

 BELLE BARRUS undertakes to send an order confirmation to the client with the characteristics of the sale.

 Upon receipt of the order confirmation by e-mail, the client shall check the characteristics of the sale and of the delivery and shall immediately report any errors or omissions.

 The sale shall not be considered final between the vendor and the client until BELLE BARRUS has confirmed by e-mail that the order has been accepted.

 Any refusal of an order shall be notified to the client within a reasonable period and in any event before the date scheduled for dispatch of the order. 

4. DELIVERY
The products ordered by the Customer shall be delivered to or collected from him within the period of time agreed with him.

 The delivery periods shall run from receipt of payment in full, unless the parties agree otherwise.

 As the products are offered subject to stock availability, delivery deadlines may be extended or the date of collection extended in the event of insufficient stock. The customer will be informed as soon as possible.

5. RECALL
The customer has the right to revoke this contract without giving any reason within a period of one day from the day on which the customer has taken delivery of the products or that the products have been taken delivery of on his behalf.

 In order to exercise his right of revocation, the client shall communicate his decision to revoke this contract by means of an unequivocal statement (for example, a letter sent by post or e-mail) to BELLE BARRUS, Kattestraat 10 – 1750 Sint-Martens Lennik |belle.barrus@icloud.com.

 The right of revocation may also be exercised online by means of the revocation form on the site www.bellebasket.be under the “exchange or return” tab; in this case, the Client shall immediately receive an acknowledgement of receipt on a durable medium.

 The Customer must return the product in perfect condition by sending it to the storage address of our products: BELLE BARRUS B.V. – rue de Bruxelles 125 – 1702 Groot-Bijgaarden, no later than one day after it has communicated its decision of revocation. This deadline shall be deemed to have been met if the client returns the goods before the expiry of the one-day period.

 The product must always be returned in its original packaging. The use, even of part of the delivery, presupposes its approval.

 In all cases, the right of withdrawal is subject to the condition that the Customer returns the new item (return costs to be borne by the Customer), complete with documentation and accessories, in its original packaging.

 If the return is carried out by the BELLE BARRUS carrier, these return costs may, upon request, be the subject of a quotation by that carrier.

 BELLE BARRUS reserves the right to refuse the return of damaged or soiled products.

 BELLE BARRUS shall reimburse the client, free of charge and, in any event, no later than fourteen days from receipt of the returned products that are complete, undamaged or soiled, the full payments already received, including delivery costs (with the exception of any additional costs if, where appropriate, the client has opted for a method of delivery other than the standard delivery proposed by BELLE BARRUS).

 BELLE BARUS shall carry out the refund using the same method of payment as that used for the initial transaction, unless otherwise agreed.

 The right of withdrawal is only possible if the packaging remains unopened at all times.

6. TERMS OF PAYMENT
An invoice shall be drawn up by BELLE BARRUS and provided to the client when placing the order via email of the delivery of the products ordered.

 The client pays via the website payment methods unless otherwise agreed between the client and BELLE BARRUS.

 A fixed amount of 7.50 euros for administrative costs shall be charged to the CUSTOMER for any payment made by means other than a bank card.

 BELLE BARRUS reserves the right to withhold the delivery of the products ordered by the client if the latter fails to pay the full price under the conditions referred to above.

 In the event of late payment or collection of all or part of the price, a default interest of 12% per annum shall be payable from the due date and without the need for prior notice of default.

 Whatever payment method is chosen, a payment shall only be considered final after the effective and complete collection of the amounts.

7. PROPERTY and TRANSITION OF RISKS
The products delivered and invoiced remain the property of BELLE BARRUS until the full collection of their sales price. The transfer of ownership only takes place after full payment, without reservation, of the price and after actual collection.

 In the event of non-payment, or in the event of partial payment, BELLE BARRUS may recover the products delivered or demand their return to BELLE BARRUS at the expense of the client, and then refund any partial payments collected after deduction of the costs incurred for the collection and recovery of the products or for their repair.

 The risks (loss, theft, destruction, etc.) associated with the products sold under retention of title and the obligation to repair any damage that the products may cause to goods and persons shall be transferred to the customer upon delivery.

8. TRANSPORT AND DELIVERY
BELLE BARRUS delivers exclusively in Belgium.

 The products will be delivered to the delivery address mentioned during the ordering process. Deliveries are made on the property line, in accordance with the terms and conditions of the carrier of BELLE BARRUS, except with the express consent of and against the relief of the carrier.

 The customer must carefully check the package upon receipt, in the presence of the carrier, and report any reservations (dents or damage to the packaging …) on the order form. If necessary, BELLE BARRUS may ask the customer to justify his reservations by sending a description and photographs.

 The reservation must be made to the carrier, and BELLE BARRUS must be informed thereof, at the latest within the day following receipt, on the delivery note or subsequently by registered letter with acknowledgement of receipt. If the carrier contests the reservation made on the delivery note, this reservation must be repeated by registered letter with acknowledgement of receipt.

 Outside this period, no complaints will be accepted and the products will be deemed to be in accordance with the order and free of hidden defects; any complaints will then be rejected.

BELLE BARRUS shall, on presentation of documentary evidence and after checking the file, replace the lost or damaged products on the basis of its legal guarantee of conformity.

 In the event of unjustified refusal of goods, the cost of return shall be borne by the client, within the framework and limits of his right of withdrawal.

 In case of force majeure or coincidence or in case of a foreign cause, in particular a fault attributable to the customer, the delivery period will be automatically extended by the duration of the hindrance. If the hindrance lasts longer than four (1) weeks, either party may terminate the contract ipso jure, without the customer being able to claim compensation.

 In the absence of the client during delivery, the date of which has been agreed with the carrier, any delivery supplement shall be payable by the client, without the possibility of lodging a complaint against BELLE BARRUS.

 The delivery period shall only be counted from the receipt of the complete order from the client and acceptance of the order by BELLE BARRUS.  The maximum delivery time shall be notified to the client as part of the online purchase procedure.

 The stated delivery period shall apply unless there is a shortage of stock: in the event of a shortage of stock, the maximum delivery period may be extended to 6 weeks from the order confirmation.

 In the event that the products ordered are not delivered after the stipulated maximum period for reasons other than force majeure or a fact on the part of the client, the sale may be terminated at the request of the client by registered letter with proof of receipt or by written notice or any other durable medium, after having given notice to BELLE BARRUS, in accordance with the same modalities, to make the delivery within a reasonable additional period. The sums paid by the client shall be reimbursed to him at the latest within 14 days of the date of termination of the contract, to the exclusion of any compensation or deduction.

9. LIABILITY AND WARRANTIES
The Products sold on the site www.bellebasket.be comply with the regulations in force in Belgium.

BELLE BARRUS cannot be held liable in the event of failure to comply with the legislation of the country (outside Belgium) in which the products are delivered. It is up to the customer to check this.

In the event of misuse, negligence, normal wear and tear of the Product, accident or force majeure, BELLE BARRUS’s warranty shall in any case be limited to the replacement or refund of the non-conforming or defective products, in compliance with the legal guarantees in force.

BELLE BARRUS undertakes to ensure that the products comply with the contract, with the specifications stated in the offer, with reasonable requirements of reliability and/or usefulness and/or with the legal requirements in force on the date of the order. 

The customer must confirm that he or she has reached the age of 18 via the pop-up displayed on the home page. By clicking further, the purchaser confirms his or her age, thus shifting the responsibility to the customer.

10. INTELLECTUAL PROPERTY
All the content of the site www.bellebasket.be , the images, texts, logos and icons and their layout are protected by copyright and are the exclusive property of the BELLE BARRUS company with the exception of trademarks, logos or content belonging to other companies or third party sites. Any reproduction, distribution, modification, transmission or publication of these various elements is strictly prohibited without the express written consent of BELLE BARRUS and may give rise to prosecution for counterfeiting.

 Any reproduction, even partial, of the content of the www.bellebasket.be site, its images, texts, logos and icons and their layout is prohibited without the prior written consent of BELLE BARRUS, which reserves the right to request financial compensation.

11. MODIFICATION OF THE SITE
BELLE BARRUS reserves the right to modify the site at any time. This concerns the modification of the products, the content of the site, the descriptions and the prices. BELLE BARRUS also reserves the right to modify the general conditions at any time.

12. DISPUTES
All disputes between BELLE BARRUS and the client arising from the interpretation, validity, execution and/or termination of the collaboration with the client shall be subject to the exclusive application of Belgian law and to the exclusive jurisdiction of the competent courts of the registered office of BELLE BARRUS unless BELLE BARRUS chooses to bring the dispute before the competent court of the registered office or place of residence of the client.

13. PRE-CONTACTUAL INFORMATION – CUSTOMER ACCEPTANCE
The Customer acknowledges that these General Terms and Conditions of Sale were communicated to him in a legible and understandable manner prior to placing his order.

• the identity of the company and its geographical address (telephone and email address)
• the essential characteristics of the product, taking into account the communication medium used and the product in question;
• the total price of the products, including all taxes or, if they were not reasonably calculated in advance, the method of calculating the price and the additional transport, delivery or postage costs, any other costs. If these costs cannot be calculated in advance, additional costs may be payable;
• the methods of payment and delivery or the methods of performance of the contract and the date of delivery of the goods or the date of performance of the services as planned by the company;

 The placing of an order by a natural person (or legal entity) on the site www.bellebasket.be

implies full agreement to and full acceptance of these General Terms and Conditions of Sale, expressly acknowledged by the Client, who shall in particular refrain from invoking any contradictory document that cannot be invoked against the Vendor.
